Welcome to the FLIM website, (the "Platform") which is operated by Flim ("us", "we" or "our"). We believe that the privacy and security of your information and data ("Information") is very important. This Privacy Policy ("Policy") explains the type of information we collect from users of the Platform, how that information is used, how information may be shared with other parties, and what controls our users have over their information. We encourage you to read this Policy carefully. Any updates or changes to this Policy will be posted on our website.

By using or accessing the Platform, you indicate and confirm that you have read, understand and agree to be bound by this Policy.

Information we collect

Two types of information may be collected through our Platform:

(1) "Personal Information" such as your name and e-mail address and other information that can be used to identify you directly, and

(2) "Usage Data" which is data related to your use of the Platform (for example, the pages you visit, the sites you use before or after using the Platform), the sites you use before or after visiting ours) or anonymous information about the computer or device used to access the Platform (for example, your IP address or device identifier).

You can access the Platform and browse its content without submitting any personal information. Whenever you visit our Platform and whether or not you submit personal information, we may collect, store or accumulate certain usage data based on your use of our Platform, such as information regarding the pages you visited, the shots you viewed, the method by which you were directed to our Platform, the URLs you visited before and after using our Platform, the browser you use, your computer's IP address, your device ID or other persistent identifier.

Use of information

FLIM collects and/or processes this data in order to :

- meet its contractual obligations and provide the information requested;
- ensure the follow-up of the commercial relationship and provide access to FLIM's customer service;
- notify you of any changes to our services;
- administer the site and carry out internal operations (e.g. troubleshooting, data analysis, tests, research, statistics);
- ensure the security of the FLIM.AI site;
- measure the audience of the FLIM.AI site, evaluate its use and improve its content.

Sharing information

Your data is shared with people working at FLIM.

We may share your data with partners located in the European Economic Area who use your data on behalf of FLIM, including service providers for software development, data management, surveys and marketing, promotional services to the extent necessary for them to perform their services for us.

Except as described above, we will not disclose, rent, sell or share personal information with third parties for marketing purposes.

Your data may also be shared with administrative or judicial authorities authorized by law as well as any authorized person, when FLIM will be obliged to disclose and/or share personal data in order to fulfil its legal obligations, to execute the Terms and Conditions of Use, or to protect your rights, property or safety and those of FLIM or third parties, as well as when we deem it appropriate to investigate, prevent or take action regarding illegal activities or suspected illegal activities.

Finally, we may share your information as part of a corporate transaction, such as a transfer, merger, consolidation or sale of assets, assignment or merger.

Your data is processed within the European Union. In the event of a transfer to a country outside the European Union, FLIM will ensure that this transfer is made to a country offering an adequate level of protection, or that it is governed by legal instruments guaranteeing said transfer a level of protection that complies with European requirements.

Privacy and security

You are entirely free to choose whether or not to provide us with personal information. We take reasonable precautions to protect our customers' personal information from loss, misuse, unauthorized disclosure, alteration and destruction. However, please remember that no data transmission over the Internet or any other wireless network can be guaranteed to be 100% secure.

Therefore, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to or receive from us, and you do so at your own risk. You hereby acknowledge that we are not responsible for intercepted information sent via the Internet, and you hereby release us from any and all claims arising out of or relating to the use of intercepted information in an unauthorized manner.

In addition, while we take reasonable steps to govern the use and protection of your personal information by our service providers, we ultimately have no control over, and are not responsible for, the privacy practices of these parties. As a condition of your use of the Platform, you expressly agree that we are not responsible for the acts, omissions or policies of our service providers or any other outside source with respect to your information.

Opting out of promotional communications

Our Platform or our communications may contain links to third-party websites with which we are not affiliated.

Your rights and obligations

You represent and warrant that all personal information you provide to us is true and correct and relates to you and not to any other person.

If you use the Platform, you are responsible for maintaining the confidentiality of your account and for restricting access to your computer or device. You accept responsibility for all activities that occur under your account.

FLIM acknowledges that the processing of your data is subject to compliance with the French Data Protection Act No. 78-17 of January 6, 1978 and the amended EU Regulation 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

In accordance with current French and European regulations, you have a permanent right of access, modification, rectification, opposition, portability and limitation of processing with regard to the information concerning you.

You also have the right to lodge a complaint with a supervisory authority in relation to the processing of your personal data (such as the CNIL).

You have the right to:

(i) To obtain access to or a copy of your personal information and to receive an electronic copy of the personal information you have provided to us, or to ask us to send this information to another company (the "data portability right") ;

(ii) To request the correction of your personal information if it is inaccurate or incomplete.

(iii) To request the deletion of your personal data. However, in this case, you will have to delete your account with us, as we need your personal data to manage it. In limited circumstances, we may be required to retain your personal data in accordance with legal requirements, even if you have requested deletion.

Data retention

We retain the personal information we receive as described in this Privacy Policy for as long as you use the Platform or as long as is necessary to achieve the purpose(s) for which it was collected, provide our services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business objectives, enforce our agreements and/or comply with applicable laws.

Specific retention periods depend on the nature of the information and the purpose for which it is collected and processed, as well as the nature of the legal requirement.

Personal data will not be retained beyond the period strictly necessary to manage the commercial relationship and apply the statute of limitations in the event of litigation.

Where we no longer have a legitimate business need or legal reason to process or retain your personal information, we will delete or anonymize it or, if this is not possible and in order to ensure that deletion does not affect the integrity of our data (for example if your personal information has been stored in a backup archive), we will store your personal information securely and isolate it from any further processing until deletion is possible.

Data used for commercial prospecting purposes will be kept for a maximum of three years from the end of the relationship. At the end of this period, FLIM undertakes to delete it.

Changes to the Privacy Policy

We reserve the right to modify this Policy at any time. If we make changes to this Policy, it will be re-displayed in the "Privacy" section of our Platform.

We therefore invite you to consult this Policy on a regular basis in order to be informed of any changes.
